By now, most of you have received a Form 1099-K, Payment Card and Third Party Network Transactions.

The rules have shifted, the thresholds have lowered, and the Internal Revenue Service (IRS) is looking closer at digital payments than ever before.

UNDERSTAND THE $5,000 THRESHOLD!

For the 2025 tax year (the returns we are filing right now in April 2026), the IRS has implemented a phase-in threshold of $5,000.

In previous years, you only received a 1099-K if you had over 200 transactions and earned more than $20,000. Those days are gone. If you grossed $5,000 or more through third-party payment processors like PayPal, Venmo, CashApp, or Etsy, that platform is legally required to send you: and the IRS: a copy of Form 1099-K.

Note: This threshold applies to the gross amount of all reportable payment transactions. This means the total dollar amount of total reportable payment transactions for participating payees without regard to any adjustments for credits, cash equivalents, discount amounts, fees, refunded amounts, or any other amounts.

DISTINGUISH BETWEEN BUSINESS AND PERSONAL TRANSACTIONS!

One of the biggest concerns I hear at our office on josestaxservice.com is: "Does this mean the money my roommate sent me for rent is taxed?"

The short answer is no. The IRS is only interested in business-related transactions.

  • Reportable Income: Payments for goods sold (like crafts on Etsy) or services rendered (like dog walking or consulting).
  • Non-Reportable Transactions: Personal gifts, splitting a dinner bill at a restaurant in Wooster Square, or receiving a reimbursement from a friend for a concert ticket.

Payment apps have been working to distinguish these by asking users to tag transactions as "Friends and Family" or "Goods and Services." If you correctly categorized your transfers, your personal reimbursements should not be included on your 1099-K. However, mistakes happen.

ACTIONABLE STEPS IF YOU RECEIVE A 1099-K!

If a 1099-K lands in your inbox, do not ignore it. The IRS already has a copy. Follow these steps immediately:

  1. Verify the Taxpayer Identification Number (TIN): Ensure the Social Security Number or Employer Identification Number (EIN) on the form is correct.
  2. Check the Gross Amount: Compare the total on the 1099-K against your own records (bank statements, app history, and invoices).
  3. Identify Personal Payments: If you see personal payments included in that $5,000+ total, you must account for them correctly to avoid overpaying your taxes.
  4. Keep Your Receipts: You only pay tax on profit, not gross revenue. You need your expense records to lower your taxable income.

THE TRAP OF SELLING PERSONAL ITEMS!

Many New Haven residents use platforms like eBay or Poshmark to sell used clothing or household items. If you sold your old couch for $600 but originally bought it for $1,200, you have a loss.

Under IRS rules, a loss on the sale of a personal item is not deductible. However, the $600 will still show up on your 1099-K if you hit the threshold. You must report this correctly so the IRS doesn't think that $600 is pure, taxable profit.

Conversely, if you sold a rare vinyl record for $500 that you originally bought for $20, that $480 is a capital gain and it is absolutely taxable.

HOW TO REPORT ERRORS ON YOUR RETURN!

If you receive a 1099-K that includes personal transactions or is simply incorrect, you should first try to contact the issuer (e.g., Venmo or PayPal) to get a corrected form. If they cannot or will not issue one in time, you must handle it on your tax return.

Use Schedule 1 (Form 1040), Additional Income and Adjustments to Income.

  • List the incorrect amount on Part I – Line 8z (Other Income).
  • Offset that amount on Part II – Line 24z (Other Adjustments) using the description "Form 1099-K Received in Error."
